Terms of Service
Effective 29 April 2026
These terms govern your use of Testimo (“the Service”, provided by us, “Testimo”). By creating an account or submitting a response on a Testimo-hosted form, you agree to these terms.
1. The service
Testimo lets businesses create branded multi-step forms, share a link with their clients, and receive AI-drafted testimonials and enquiries into their own systems (e.g. Google Sheets). Two roles interact with the Service:
- Customers — businesses that operate one or more tenants on Testimo.
- Respondents — the people invited by a customer to fill in a form.
2. Accounts
You must be at least 16 years old and able to enter binding contracts to create a customer account. You’re responsible for keeping your credentials secure and for activity under your account. Notify us at info@testimo.app if you suspect unauthorised access.
3. Acceptable use
You agree not to:
- Use the Service to collect testimonials or other content without the meaningful consent of the people providing it.
- Send unsolicited bulk email through Testimo’s invite feature, or use the Service to harass, defame, or deceive.
- Attempt to reverse-engineer, scrape, or interfere with the Service’s operation, or to bypass authentication or tenant boundaries.
- Upload content that infringes intellectual property, misrepresents identity, or contains malware.
- Use the Service for anything illegal in your jurisdiction or ours (Australia).
We may suspend or terminate accounts that violate these rules.
4. Your content
You retain ownership of the forms you create, the configuration you author, and the responses your respondents submit (collectively, “Customer Content”). You grant Testimo a limited licence to host, transmit, and display Customer Content solely as needed to provide the Service to you (including forwarding responses to your connected Google Sheet, generating AI-drafted testimonials, and sending notification emails).
You are responsible for the lawfulness of Customer Content, including obtaining respondent consent under any applicable privacy law (GDPR, CCPA, the Australian Privacy Principles).
5. AI-generated drafts
The AI-drafted testimonial shown to respondents is a suggestion generated by a third-party model (currently Google Gemini) based on the answers the respondent gave. Respondents may edit it before submitting. Testimo does not guarantee that AI output is accurate, complete, or free of error, and customers must not publish AI-drafted testimonials as if they were verbatim quotes unless the respondent confirmed the wording.
6. Pricing & trials
Pricing, free-trial duration, and any included usage limits are shown on testimo.app or communicated when you sign up. We may change pricing on at least 30 days’ notice; changes do not apply retroactively to a prepaid period.
7. Service availability
We aim for high uptime but do not promise an uptime SLA on free or trial plans. The Service is provided “as is” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, Testimo’s total liability arising out of or relating to these terms or the Service is limited to the amount you paid Testimo in the 12 months immediately preceding the claim, or AUD $100 if you have paid nothing. Testimo is not liable for indirect, consequential, incidental, special, or exemplary damages, including lost profits, lost revenue, or lost data.
Nothing in these terms excludes liability that cannot be lawfully excluded under applicable consumer protection law (including the Australian Consumer Law).
9. Termination
You can stop using the Service and delete your account at any time by emailing info@testimo.app. We may terminate or suspend your access if you breach these terms or if we discontinue the Service. On termination we’ll delete your data per our Privacy Policy.
10. Changes
We’ll update the effective date at the top of this page and notify customers of record before any change that materially reduces your rights or imposes new obligations.
11. Governing law
These terms are governed by the laws of Victoria, Australia. Disputes go to the courts of Victoria, except where applicable consumer law gives you a non-waivable right to bring proceedings in your home jurisdiction.
